Legal Action Against Kangana Ranaut: Understanding the FIRs Filing by Sushant Singh Rajput's Family

On September 8, 2020, the Mumbai police registered three FIRs against actress Kangana Ranaut following a complaint filed by Rhea Chakraborty, the live-in partner of the late actor Sushant Singh Rajput. This development has sparked significant legal action and reopened the probe into the controversial circumstances surrounding Rajput's death.

Legal Allegations and Procedural Issues

According to Sushant Singh Rajput's family lawyer, Vikas Singh, the FIR filed by the Mumbai police is illegal and a clear case of contempt due to the presence of the complainant, Rhea Chakraborty, whose previous acquittal by the Supreme Court sets a precedent.

Mr. Singh argued that the investigation into Rajput's death is a serious matter involving multiple agencies such as the Central Bureau of Investigation (CBI), Enforcement Directorate, and the Narcotics Control Bureau. He stated that these agencies would not allow the accused to deflect the investigation by filing such complaints. The lawyer emphasized that the Mumbai police can only register FIRs related to inquest proceedings, and that an FIR cannot be lodged against a doctor without the presence of a medical team.

Accusations and Controversies

In her complaint, Rhea Chakraborty has accused Rajput's sister, Priyanka Singh, and a Delhi-based doctor, Dr. Tarun Kumar, of forgery and providing a fake prescription for anxiety medications. Chakraborty sought that both individuals be booked under relevant sections of the Indian Penal Code, the Narcotics Drugs and Psychotropic Substances (NDPS) Act, and the Telemedicine Practice Guidelines.

The circumstances surrounding Sushant Singh Rajput's death are under scrutiny, with his father, K.K. Singh, filing complaints in Patna against Chakraborty and several others, accusing them of cheating and abetting his son’s suicide. The father also claimed that the accused had siphoned off an alleged 15 crore from his son's bank accounts, leading to further investigations by the Enforcement Directorate.

Multiple Agencies Involved in the Investigation

The complexity of the case has led to multiple agencies investigating various aspects of the incident. While the Patna police lodged a complaint against Chakraborty and others, it was transferred to the Central Bureau of Investigation (CBI). The Narcotics Control Bureau (NCB) is probing the possible drugs angle in the case, adding a multi-layered investigation to the already controversial situation.

Legal Decision on Than Contempt of Court Allegations

Following these filings, there is a pending decision over whether the family of Sushant Singh Rajput will file a contempt plea or quashing of Rhea Chakraborty’s complaint. Mr. Singh mentioned that a decision would be taken accordingly during the day.

As this situation continues to unfold, it is clear that the legal and public interest dimensions of the case will be closely monitored, with a focus on ensuring due process and the integrity of the investigation.
